(“Terms and Conditions”)
I. General Provisions. System Operation
- These Terms and Conditions specify the terms of use and access to the eBOK system operated by SPRAVIA sp. z o.o., based in Warsaw (address: Skierniewicka 16/20, 01-230 Warsaw), registered in the National Court Register (“KRS”) under number 0000227270, NIP 5272458715, with share capital of PLN 657,333,000.00 (“Company”) (“System”).
- The System is managed by the Company, but where the Company has not entered into an Agreement with the User (as defined below), the Company operates the system on behalf of its relevant subsidiary that has entered into the Agreement with the User.
- The System is available at ebok.spravia.pl.
- Access to the System may be requested by any entity that has entered into a development agreement, implementation agreement, preliminary sale agreement, or property transfer agreement with the Company or its subsidiary responsible for the relevant development project (“User”) (“Agreement”).
- Any User utilizing the System in any way confirms that they have read the Terms and Conditions. The Terms and Conditions are made available to the User free of charge via the System in a form that allows for downloading, saving, and printing.
- User access to the System is provided online.
- To log in to the System, it is necessary to provide an email address and a mobile phone number.
- An email will be automatically sent to the email address provided when signing the Agreement, informing the User about the possibility of activating the System and setting a password.
- After receiving the activation email, the User should click on the link (website address) included to confirm registration and log into the System for the first time.
- The new password must:
- Be at least 8 characters long;
- Contain both uppercase and lowercase letters, special characters, and numbers;
- Be periodically changed, at least once a year;
- Differ from the last 5 passwords.
- Upon the first login to the System, a verification code will be sent to the mobile number provided at the signing of the Agreement. The code will be valid for 15 minutes.
- The User is responsible for securing their login and password from unauthorized access. The User bears full responsibility for all consequences resulting from the use of the System by third parties who gain access to the User’s login or password.
- The password should be periodically changed by the User, at least once a year. If the User does not change the password, access to the System will be temporarily suspended until a new password is set.
- After logging into the System, the User can change their password at any time.
- If the User’s access to the System is blocked, restoring access will require contacting the Company or its relevant subsidiary with which the Agreement was made.
- The System is available to Users 24 hours a day, 7 days a week. The Company is entitled to make interruptions in the availability of the System for the purpose of periodic maintenance or updating the IT system. As a result, it may be necessary to re-establish access to the System, including setting a new password, after prior contact with the Company or its subsidiary with which the Agreement was made.
- The Company may modify the services available in the System, expand or suspend their operation, and add new services at any time without giving a reason.
- The Company is entitled to change the System’s operational rules.
- The Company is entitled to block the User’s account if it is used in violation of these Terms and Conditions or applicable law.
- The Company will immediately block access to the system if the Agreement with the User is terminated or the rights from the Agreement are transferred to another entity, other than a subsidiary of the Company.
II. Provision of Electronic Services
a. Types of Services Provided
The Company or its relevant subsidiaries, depending on which entity enters into the Agreement with the User, provide the following electronic services (“Services”):
- Access to information regarding the history and schedule of payments made/to be made by the User to the Company or its subsidiary;
- Access to and the ability to download documents signed by the User, invoices, and documents related to the project;
- Access to information regarding the schedule of a given project’s implementation;
- Access to information regarding the schedule of tenant changes;
- Facilitating contact between the User and the Company or subsidiary;
- Managing the User’s account in the System – changing login or password.
b. Agreement Conclusion and Termination. Withdrawal from the Agreement
- The agreement for the provision of electronic services is concluded when the User accesses the System containing the Services or uses a redirect to such pages in the System.
- Starting to use the System and any of the Services is equivalent to the full acceptance of the Terms and Conditions by the User without the need for a separate agreement.
- The Agreement may be terminated by the User, the Company, or the relevant subsidiary at any time, with immediate effect.
- A consumer User may withdraw from the electronic services agreement within 14 days of its conclusion by sending a written withdrawal notice to the Company’s or subsidiary’s address specified in the Terms and Conditions.
- The right to withdraw from the agreement does not apply if, with the User’s consent, the Company or subsidiary has started providing the Service before the expiration of the 14-day withdrawal period.
c. Additional Provisions
- To use the System and Services, the User must meet the following technical requirements:
- Access to the Internet;
- An email account;
- Access to an internet browser: ebok.spravia.pl.
